Coming soon…Legacy Donations to the Norfolk Tortoise Club

The Norfolk Tortoise Club would be very pleased to accept a gift (legacy) from your Will to help its vital work in the promotion of tortoise welfare and the provision of a rehoming service for tortoises in need of care and attention. All gifts will make a tremendous contribution to tortoise care and greatly supplement the fund rising undertaken by Club supporters and volunteers.

To ensure that the intentions in your Will are fully implemented without misunderstanding it is recommended that the services of a solicitor are obtained.

As a registered Charity the Club is advised that a gift (legacy) is exempt from inheritance tax. You are advised though to check this with your solicitor.

If you have decided that you would like to leave a gift to the Norfolk Tortoise Club in your Will, the following are suggested wordings for you to share with the solicitor preparing your Will

A gift of a share of the estate (residuary gift)

‘’I give to the Norfolk Tortoise Club, Charity registered in England and Wales no 1174886 of PO Box 249, Bracon Ash, Norwich NR14 8WY the residue (or % share of the residue) of my estate absolutely and I direct that (1) the proceeds may be used for the general purposes of the Norfolk Tortoise Club and (2) a receipt signed by a person for the time being authorised by the Norfolk Tortoise Club shall be a good and sufficient discharge to my executors.’’

A fixed sum (pecuniary gift)

‘’I give to the Norfolk Tortoise Club, Charity registered in England and Wales no 1174886 of PO Box 249, Bracon Ash, Norwich NR14 8WY the sum of £………….and I direct that (1) the proceeds may be used for the general purposes of the Norfolk Tortoise Club and (2) a receipt signed by a person for the time being authorised by the Norfolk Tortoise Club shall be a good and sufficient discharge to my executors.’’

Have a collection at your funeral

Another way you could help the Norfolk Tortoise Club is by making donations to the Club at your funeral. If that is your intention the following wording is suggested for your will,

‘’I request my executor to ensure that donations at my funeral are made to the Norfolk Tortoise Club, Charity registered in England and Wales no 1174886 of PO Box 249, Bracon Ash, Norwich NR14 8WY ‘’

If you are requesting donations at your funeral to made to the Norfolk Tortoise Club it would be very helpful if you could leave instructions for your executor to contact the Club as it should be possible for the provisions  of the governments ‘’Gift Aid’ ’scheme to be applied . This will enable an additional tax benefit to be received by the Club.

The legal terms used in these suggested wordings are,

Estate – everything you own including your house, money and any life insurance policies that will be paid on death

Specific Legacy – a gift of a specific item, or asset such as shares or jewellery

Pecuniary Legacy – a fixed sum of money. Inflation can reduce the value of a pecuniary legacy over time, so it is worthwhile reviewing your will on a regular basis

Residuary Legacy – a gift of all or part of your net estate (what remains after all taxes, specific gifts and cost of administering the estate has been paid). This type of legacy should be expressed as a percentage or share of your estate

Executors – people chosen by you to carry out the instructions contained in a Will.
